That act defines hemp as: “all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a Delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent.” In short, as long as THCV is hemp-derived and has less than 0.3% Delta 9 THC in its lab results, then the distillate is considered to be legal.
